Terms of Service
These Terms of Service ("Terms") are a binding agreement between you and Hey AI, Inc. ("Hey AI," "we," "us"). They govern your use of the hey.ai website, the Hey Cleanup browser extension, the Hey iPhone app, our APIs, our phone calls, and any related services (collectively, the "Services"). By creating an account or using the Services, you agree to these Terms and to our Privacy Policy.
Key points before you read: Hey is an AI product. Its reports, answers, drafts and suggestions are written by software, can be wrong, and are not a substitute for professional advice. You must be 18+ to create an account. Subscriptions auto-renew until you cancel. Disputes are resolved by binding individual arbitration, and you waive the right to bring class actions. You can opt out of arbitration within 30 days of account creation (see Section 21).

1. About Hey
Hey is a personal-data product. You import your own data exports (for example from Facebook, Instagram, Google, Netflix, Amazon, or Uber), and Hey analyses them. It writes reports about your life, answers your questions about your own history, drafts posts and messages in your own voice in Write, and, where supported, helps you remove content you have outgrown through our Chrome extension. Cleanup removes only the items you approve, singly or all at once. Some features are paid for with credits (Section 13).
Character features. Hey also includes AI characters, such as coaches and companions, that text from a conversation, can call you, and remember context across sessions, and a Kids mode. These are no longer offered to new users. If you already use them, mostly in the Hey iPhone app, you can keep doing so, and Sections 6, 8, 9, 10 and 12 apply to them.
Every analysis, answer, report, draft and character is software running on AI models. AI output can be wrong, and characters are not real people.
2. Your data imports
What you may upload. You may upload data exports that the relevant service issued to you about your own account. You represent that you have the right to upload each export and to have us process it.
Other people in your export. A personal export normally contains content created by other people — messages they sent you, their comments, their names and handles. We process that material only to produce your own reports and answers. We do not build profiles of those people, sell their data, or make your export available to other users. If you are subject to data-protection law as a controller of that material, you remain responsible for your own compliance. If someone asks you to remove their data from your account, delete the relevant import.
How imports are processed and versioned. An accepted export is parsed into structured tables held in your account and pinned to an import version. Adding, replacing or re-uploading an export creates a new version. We may retain earlier versions for a limited period for recovery and then remove them.
Completeness. We parse exports in the formats the platforms publish. Those formats change without notice, exports are sometimes incomplete or truncated by the platform, and an import may fail or succeed only in part. We do not warrant that any import captures everything in your account, and analysis built on a partial import will itself be partial.
Deleting an import. You can delete an import at any time from your account. See Section 11.
3. Reports, answers, drafts & shared links
What they are. Reports and answers are generated by AI models reading your imported data. Where a figure is shown with a citation, it is drawn from a specific row of your own export and you can check it. Where a passage is marked as interpretation, it is a model's reading of your data and not a measurement — it may be wrong, and reasonable readers may disagree with it.
Not advice. Nothing in a report or answer is financial, legal, medical, employment or psychological advice. Section 7 applies in full.
Accuracy. AI output can contain errors, including errors in numbers and in dates. Do not rely on a report for any consequential decision without checking the cited source rows. We do not warrant that any report is accurate, complete or current.
Sharing. If you choose to publish a report, a card or a link, you make that content available to anyone who has the link for as long as it remains published. Shared content may reveal personal information about you and about third parties who appear in your export. Deciding to share is your decision and your responsibility; you can unpublish a link at any time, though copies others have already made are outside our control.
Drafts in Write. Write drafts posts and messages for you. To match your voice it reads posts and comments you wrote, taken from your imports, and, unless you turn them off for a draft, your memories (short facts Hey has saved from your conversations). Hey does not publish anything for you. Whether to use a draft, and where, is your decision, and you are responsible for what you post.
Changes. Report templates, visuals and wording change as the Services develop. We may regenerate, change the presentation of, or withdraw a report type.
4. Cleanup & the browser extension
What cleanup does. Cleanup reviews content in your imported archive and proposes items you may wish to remove from the originating platform. If you install our browser extension and approve items, the extension acts in your own browser, in your own logged-in session, to remove the items you approved.
You are the one acting. We do not hold your platform passwords, and we do not log into, access or act on your platform accounts from our servers. Every removal is carried out locally by software running in your browser under your own session, at your instruction, item by item. You can stop a run at any point, and you can uninstall the extension at any time.
Removal may be permanent and may fail. Removing content is frequently irreversible. Some platforms offer a trash, archive or restricted-visibility option and many do not. Review each item before you approve it. We do not warrant that any removal will succeed, that it will be complete, or that removed content will not persist in the platform's own backups and caches, in search-engine indexes, in archives operated by third parties, or in copies held by other people. Deleting a post does not delete other people's copies of it.
The platform's rules still apply to you. Your use of each platform remains governed by that platform's own terms of service, which may restrict automated or scripted interaction with the site. You are responsible for your own compliance with them, and you accept the risk that a platform may limit, suspend or terminate your account for activity it considers automated. We may add, change or withdraw support for any platform at any time, including at short notice.
Permissions and scope. The extension requests only the browser permissions described in its store listing and privacy disclosure, and operates only on the platforms it names. It does not read or act on pages outside that scope.
Your judgement governs. A cleanup suggestion is an AI model's opinion about your own content. It has no knowledge of your circumstances, obligations or reasons for keeping something — including any duty you may have to preserve material for legal, regulatory or employment reasons. Approving an item is your decision alone.
5. Eligibility & accounts
You must be at least 18 years old to create an account. By creating an account, you represent and warrant that you are at least 18 and have full legal capacity to enter these Terms.
Accounts are created with a phone number verified by SMS or with a Google account. You are responsible for keeping access to that phone number or Google account secure. Notify us at security@hey.ai if you suspect unauthorised access.
If you already use Kids mode in the Hey iPhone app to set up character calls for children in your household, the account holder is always the adult. See Section 12.
6. Phone calls (character features)
This section applies only if you use character calls. If you set up calls from a character, or ask a character to call you, you expressly consent to receive automated voice calls from Hey AI at the phone number on your account, using artificial voices and automatic dialing technology, on the schedule you configure or when you ask. Standard call and data rates may apply. Consent is not a condition of any purchase.
Hey does not send you text messages, apart from the one-time sign-in codes you request.
You can stop calls at any time by:
- Cancelling them under Menu (☰) → Scheduled calls in the Hey iPhone app, or at hey.ai/app/scheduled; or
- Emailing info@hey.ai with the phone number on your account.
We retain a record of your consent timestamp.
7. AI outputs & no professional advice
All speech, text, voice, and recordings produced through the Services are generated by AI language models and synthesised voices. The Services are not a substitute for professional advice — they are not a doctor, therapist, lawyer, financial advisor, dietitian, trainer, or any other licensed professional. Do not rely on AI outputs to make medical, legal, financial, mental-health, safety, or other consequential decisions.
If you are in crisis or having thoughts of harming yourself, contact local emergency services or a crisis line (in the US, dial 988).
AI outputs may be inaccurate, biased, offensive, or otherwise unsuitable. Voices that imitate public figures are AI imitations for personal use only and are not endorsements by those individuals.
8. Voice clones & biometric data
Hey no longer lets you create voice clones. If you created one earlier, you represented and warranted that you had obtained explicit consent from any person whose voice you uploaded (including your own consent if you uploaded your own voice). Voice samples and cloned voice models are biometric identifiers under several state and national laws. Uploading another person's voice without their consent is a misuse of the Services and may violate applicable laws (including Illinois BIPA, Texas CUBI, and the EU GDPR).
We may delete cloned voices at our discretion. We delete any voice clone you created when you delete your account, and you can ask us to delete one sooner by emailing privacy@hey.ai.
9. Connected services
You may upload your own platform data exports (Facebook, Instagram, YouTube, Google, LinkedIn, Reddit, Netflix, Amazon, Uber, DoorDash) and connect third-party services (Google Calendar and Gmail, Apple HealthKit in the Hey iPhone app). When you connect a service or upload an export, you authorise Hey AI to read only the data we need to operate the relevant feature. If you connect Google, Hey's assistant can read your calendar and search your email, and when you ask it to, it can add a calendar event or send or reply to an email. Characters can also read your calendar to plan calls.
We do not sell connected-service data. We use it only to provide the Services and only for as long as you keep the connection active. You can disconnect a service at any time in your account settings, or remove Hey's access in your Google account or in iOS Settings.
10. Calls: live transcription, summaries & storage
If you use character calls, each call is transcribed live and summarised so the character can pick up where you left off. We do not store raw call audio — audio is streamed for live speech-to-text and is not recorded; what persists is text (a summary and a recent-dialogue memory), plus any voice messages you or a character deliberately create in a conversation. By using calls you consent to this live transcription and summarisation of calls between you and the AI character. Some U.S. states require all-party consent to recording — the Services identify every call participant as AI (on the incoming-call screen and in-call), and by accepting these Terms you consent to the transcription described here for yourself and the AI participant.
Summaries and any voice messages are stored in your account; you can delete individual items at any time, or disable transcript/summary saving in Settings. See the retention table in the Privacy Policy and our published safety & crisis protocol at hey.ai/safety.
11. Privacy & deletion
Our Privacy Policy explains what data we collect, how we use it, who we share it with, and how to exercise your rights. You can permanently delete your account on the web in Settings → Delete account, or in the Hey iPhone app under Menu (☰) → Settings → Account → Delete account. Deletion is irreversible and removes your imported data exports and the tables built from them, your saved reports and answers, your Write drafts and memories, your cleanup review decisions, your conversations with Hey's assistant and characters, call history, goals, logs, voice clones, child profiles, and user-keyed files in cloud storage. Deleting your Hey account does not remove anything from the platforms your data came from, and does not restore anything cleanup has already removed there. See hey.ai/data-deletion if you don't have app access.
12. Kids mode (COPPA / parental control)
The Services are not intended for use by children under 18 as account holders. Kids mode lets a parent or legal guardian set up curated character interactions for their child under the parent's account. It is available only in the Hey iPhone app, to people who already use it, and is not offered to new users.
If you use Kids mode, you:
- Confirm you are the child's parent or legal guardian;
- Provide the in-app parental consent BEFORE any child profile is created or any call is placed (Hey AI obtains and records this consent as the service operator; you may withdraw it at any time in Settings, which re-blocks kids calls and new profiles);
- Agree to supervise the child's use — kids calls always ring your verified phone; and
- Agree that the child profile is operated under your account and that you can delete it (and the child's call summaries and history, which delete with it) at any time.
Every Kids-mode character is labeled as AI and discloses to the child, in kid-friendly language, that it is a computer voice and not a real person. AI companion characters may not be suitable for some minors — supervision and the decision to use Kids mode are yours. Our children's data practices, including the published children's data-retention policy, are in Privacy Policy §8, and our crisis protocol is published at hey.ai/safety.
We do not knowingly collect personal information from children under 13 outside of Kids mode. If we learn that we have done so, we will delete it.
13. Subscriptions, payments & cancellation
Some features of the Services require payment. Pricing, billing cadence and what each plan includes are shown at checkout and on our pricing page.
What is charged for. Importing your data is free. Paid features are paid for with credits: for example, a report, or a draft in Write on a paid model. A monthly plan grants credits, and you can also buy credit packs. What each action costs, and what a plan or a pack includes, are shown on our pricing page and before you spend. Some use is included at no charge, within limits that we may change.
How you pay. Purchases on the website are processed by Stripe. Purchases in the Hey iPhone app are processed by Apple through the App Store (in-app purchase via Apple StoreKit). The payment processor you used at checkout is the one that bills you on renewal.
Auto-renewal. Subscriptions automatically renew at the end of each billing period at the then-current price unless you cancel before the renewal date. You will not receive a separate reminder before each renewal except where required by law.
Cancellation.
- In-app purchase (Apple): manage and cancel from your Apple ID at apps.apple.com/account/subscriptions or iOS Settings → your name → Subscriptions. Cancellation prevents the next renewal; the current period continues until it ends.
- Stripe (web): cancel from Credits in your account on the web or by emailing info@hey.ai.
Refunds. For Apple in-app purchases, refunds are handled by Apple under Apple's policies; submit refund requests at reportaproblem.apple.com. For Stripe purchases, refunds are issued at our discretion. Refunds required by law (e.g., EU withdrawal rights) will be honoured.
Free trials and promotional pricing. If a trial converts to a paid subscription, it does so automatically at the end of the trial unless cancelled. Promotional pricing is not guaranteed beyond the stated term.
Price changes. We may change subscription prices. We will give you advance notice and, where required by law, your consent or the opportunity to cancel before the new price takes effect.
14. Acceptable use
You agree not to:
- Impersonate a real person without their consent;
- Place calls or send messages to phone numbers you do not own or control without consent;
- Generate harassing, defamatory, threatening, or unlawful content;
- Generate sexual or sexually suggestive content involving real persons without their consent, or any content sexualising minors;
- Generate content intended to deceive others (e.g., voice clones used to defraud a third party);
- Circumvent rate limits, billing controls, or security measures;
- Scrape, mine, or resell platform data;
- Use AI outputs as professional advice;
- Reverse-engineer, decompile, or otherwise attempt to extract source code or model weights, except to the extent applicable law permits and our written consent allows;
- Use the Services in violation of any applicable law or third-party terms (including the TCPA, GDPR, COPPA, BIPA, Twilio's AUP, App Store Review Guidelines).
We may suspend or terminate accounts that violate these rules.
Zero tolerance for objectionable content and abusive users. There is no tolerance for objectionable content — including content that is harassing, hateful, threatening, sexual, violent, or that exploits, sexualises, or endangers any person, especially a minor — and no tolerance for abusive behaviour toward others or toward an AI character. If you see content or behaviour that violates this policy, report it in the Hey iPhone app (open the conversation or long-press the message and choose Report) or email support@hey.ai. We review every report and act on objectionable content and the users responsible — including removing the content, removing the offending character, and ejecting or banning the user — within 24 hours. AI characters are additionally instructed to refuse and stop producing objectionable content, and we remove any character that violates this policy.
15. Your content & license
You retain ownership of content you upload or generate through the Services (your data exports, messages, drafts, voice samples, documents, prompts, photos, and goals — your "Content"). You grant Hey AI a worldwide, non-exclusive, royalty-free licence to host, store, transmit, transcribe, process, and display your Content solely to operate, secure, and improve the Services for you. This licence ends when you delete the Content or your account, except to the extent we are required to retain it by law or to defend legal claims.
We do not use your Content to train third-party AI models. Where we use AI sub-processors, we use accounts configured to opt out of training where the provider offers that option.
16. Intellectual property
Hey AI and its licensors retain all rights, title, and interest in and to the Services, including all software, designs, trademarks, models, datasets, prompts, and non-user-generated content. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Services for personal, non-commercial use, subject to these Terms.
Trademarks: "Hey AI" and the hey logo are trademarks of Hey AI, Inc. Other trademarks belong to their respective owners.
17. Termination
You may stop using the Services at any time and delete your account in Settings. We may suspend or terminate your access if you violate these Terms, if continued provision of the Services to you is no longer commercially viable, or as required by law. Where reasonable, we will give notice. Sections that by their nature should survive termination (including Sections 12, 13, 15-18, and 20) will survive.
18. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, HEY AI DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY OF AI OUTPUTS, UNINTERRUPTED OR ERROR-FREE OPERATION, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL MEET YOUR REQUIREMENTS OR THAT AI OUTPUTS WILL BE ACCURATE, COMPLETE, OR APPROPRIATE.
Some jurisdictions do not allow disclaimer of certain warranties; in those jurisdictions, the disclaimers above apply only to the extent permitted.
19. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- HEY AI IS NOT LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, LOSS OF GOODWILL, OR COST OF SUBSTITUTE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY.
- HEY AI'S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICES IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID HEY AI IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $100.
Some jurisdictions do not allow these limitations; in those jurisdictions, our liability is limited to the smallest extent permitted by law. Nothing in these Terms limits liability that cannot be limited by law (such as liability for gross negligence, wilful misconduct, fraud, or death/personal injury caused by negligence).
20. Indemnification
You agree to indemnify, defend, and hold harmless Hey AI, its officers, directors, employees, and agents from and against any third-party claims, damages, liabilities, and reasonable expenses (including attorneys' fees) arising out of (a) your breach of these Terms; (b) your misuse of voice cloning or impersonation features; (c) your placement of calls or messages without proper consent; or (d) Content you upload, generate, or distribute through the Services.
21. Disputes & arbitration
Informal resolution first
Before filing any claim, you and Hey AI agree to try to resolve the dispute informally for at least 60 days. Send a written notice to legal@hey.ai describing the dispute and the relief you seek.
Binding individual arbitration
You and Hey AI agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services (each, a "Dispute") will be resolved by binding individual arbitration, except as provided below. Arbitration will be administered by JAMS under its Streamlined Arbitration Rules, by a single arbitrator, in San Francisco, California (or, at your election, your home jurisdiction or by remote hearing). The arbitrator's decision is final and binding. Judgment on the award may be entered in any court of competent jurisdiction.
Class action waiver
You and Hey AI each waive the right to participate in a class action, class-wide arbitration, or representative action. Disputes will be resolved only on an individual basis.
Exceptions
The following are not subject to arbitration: (a) small-claims court actions; (b) actions to enjoin infringement of intellectual-property rights; (c) Disputes that applicable consumer protection law requires be resolved in court.
30-day opt-out
You may opt out of this arbitration agreement by emailing legal@hey.ai within 30 days of first creating your account, with the subject line "Arbitration Opt-Out" and your phone number on file. Opting out does not affect any other provision of these Terms.
Governing law
These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law principles. For users in the EEA, UK, or Switzerland, mandatory consumer-protection provisions of your home jurisdiction continue to apply.
22. Apple App Store EULA addendum
The following terms apply only to the version of the Services delivered as an iOS application through the Apple App Store (the "Licensed Application"):
- Parties. These Terms are a binding agreement between you and Hey AI, and not with Apple Inc. ("Apple"). Hey AI, not Apple, is solely responsible for the Licensed Application and its content.
- Scope of licence. The licence granted to you is non-transferable and limited to use of the Licensed Application on any Apple-branded products that you own or control, and as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the Licensed Application may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.
- Maintenance & support. Hey AI is solely responsible for providing any maintenance and support for the Licensed Application. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the Licensed Application.
- Warranty. Hey AI is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the Licensed Application fails to conform to any applicable warranty, you may notify Apple, who will refund the purchase price (if any) for the Licensed Application. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation with respect to the Licensed Application, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be Hey AI's sole responsibility.
- Product claims. Hey AI, not Apple, is responsible for addressing your or any third party's claims relating to the Licensed Application or your possession and use of it, including (i) product liability claims; (ii) any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation, including in connection with the Licensed Application's use of HealthKit or HomeKit frameworks (if any).
- Intellectual property. In the event of any third-party claim that the Licensed Application or your possession and use of it infringes that third party's intellectual property rights, Hey AI, not Apple, will be solely responsible for the investigation, defence, settlement, and discharge of any such claim.
- Legal compliance. You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Third-party terms. You agree to comply with applicable third-party terms of agreement when using the Licensed Application (e.g., your wireless data services agreement).
- Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
23. General terms
Changes. We may update these Terms from time to time. Material changes will be communicated by email, push notification, or in-app notice at least 14 days before they take effect. Your continued use of the Services after the effective date constitutes acceptance.
Assignment. You may not assign these Terms. We may assign them to an affiliate or successor in connection with a merger, acquisition, or sale of assets, on notice to you.
Entire agreement. These Terms, together with the Privacy Policy and any plan-specific terms shown at checkout, are the entire agreement between you and Hey AI.
No waiver; severability. Failure to enforce any provision is not a waiver. If any provision is held unenforceable, the remainder remains in effect.
Force majeure. Neither party is liable for failure to perform due to events beyond reasonable control (natural disasters, network outages, government action, etc.).
